How do you transfer a car loan to someone else after a divorce?

You typically cannot simply transfer a car loan from one person to another without the lender's approval, and most lenders won't allow it. The loan is tied to the vehicle and the borrower's creditworthiness, so transferring it usually requires the new owner to refinance the car in their own name. During divorce proceedings, the court usually awards the vehicle to one spouse, but that doesn't automatically remove the other spouse from the loan obligation. If both names are on the loan, both are legally responsible to the lender regardless of what the divorce decree says. The cleanest approach is for the spouse keeping the car to refinance it in their name alone. This removes the other spouse from liability and gives the lender confidence in the new borrower's ability to pay. The spouse keeping the car will need decent credit, stable income, and enough equity or income to qualify on their own. If the keeping spouse has weaker credit or income, adding a cosigner (not the ex) can help. Alternatively, one spouse can buy out the other's interest and then refinance, or the car can be sold and the loan paid off from proceeds. Common questions

What if my ex won't refinance and my name is still on the loan?

You remain legally liable to the lender even if the divorce decree says your ex is responsible; the lender can pursue you for missed payments. Your best move is to contact the lender directly and request removal, or push your ex to refinance quickly—some divorce attorneys can add refinancing deadlines to the settlement.

Can I just have my ex sign the title over to me?

Signing over the title doesn't remove them from the loan; the lender still has a lien on the vehicle and both borrowers remain obligated until the loan is refinanced or paid off.

What if the car is worth less than what's owed?

This is called being underwater; refinancing becomes harder because lenders typically won't lend more than the car's value, so you may need a larger down payment or cosigner to make it work.
